Waiver of Risk & Liability
PLAY AT YOUR OWN RISK
The Player agrees that any injury that occurs to them or their guests during any scheduled event is not under the Rolling Red’s liability and falls under the player’s liability. It is up to each player to familiarize themselves with the facilities of each course and understand where all dangers are and where the safest and most convenient locations are in the case of unexpected weather or other outside factors.
If a player is uncomfortable in a situation due to outside factors and believes their safety is being compromised, they are urged to seek the nearest shelter to protect the player’s & their guests' safety.
The Rolling Red Golf Tour LLC cannot be held liable for risk of injury or death caused by any reason including but not limited to:

Falling off a bridge, contracting any sicknesses or diseases, getting struck by lightning, twisting an ankle, suffering from heat stroke, being impaled by a falling branch, getting attacked by an animal, contracting frostbite, breaking a bone, getting struck by a golf club or ball, falling off a cliff, drowning, et cetera.
The Rolling Red Golf Tour LLC and its team members are not responsible for any injury that occurs to any player, caddie, guest, or spectator at any tournament.
Any injury at all or death caused from improperly using golf carts or not paying attention to course conditions that the players are driving on, is the fault of the driver and cannot hold the Rolling Red Golf Tour liable for such incidents that the Rolling Red could not have reasonably been able to prevent.
All players, their guests, their caddies, and anyone who attends a Rolling Red event on the host golf course’s site assumes full risk and responsibility of injury or death for any cause or reason.
The Rolling Red pledges to minimize the risk of any of these situations within reasonable expectations such as pausing all play in the case of nearby dangerous weather, but cannot guarantee 100% safety to all players, guests, and spectators at any given time due to the nature of the environment and golf courses being spread out and unsafe due to their geography, wildlife, etcetera.
The Rolling Red Golf Tour LLC cannot be held responsible for any losses of income or entry fees as a result of injury or death from playing in a Rolling Red Tournament. Players understand the physical demands of playing golf in many different weather conditions for extended periods of time.
As the player, you also sign this on behalf of your caddie and any guests you bring with you to a tournament. Tournament being defined as the moment the Rolling Red Golf Tour arrives to a course and the moment the Rolling Red leaves.
Waiver of Expected Product or Service
The Rolling Red Golf Tour LLC will make every effort to host and complete every event as scheduled and intended. However, unexpected weather and unforeseen circumstances may cause an event to be delayed, shortened, modified, or even cancelled. In such cases involving delaying, shortening, modifying, or cancelling of an event, any refunds or credits will be determined on a per event basis. By signing below, you understand, fully agree, and accept any decisions deemed necessary by the Rolling Red Golf Tour LLC including, but not limited to, delaying, shortening, modifying, and/or cancelling any event. Pro-Am Entry Fees will follow the same withdrawal & refund policies as the Tour Player's Entry Fees.
Golf Cart Waiver
Each individual that utilizes a golf cart for the tournament has a responsibility to ensure the cart is operated and maintained in a safe manner. Responsible driving requires concentration, sound judgement, and common sense on your part. Don’t compromise your health and safety or the health and safety of others by operating carts irresponsibly.
By signing this waiver, you are stating you have read these rules and will obey them so accidents and injuries can be prevented.
1. The cart should only be driven by you. No one else should drive the cart unless your physical impairment prevents you from driving. If someone else must drive the cart, make sure they are aware of and abide by these rules.
2. Do not allow any other non-approved individual to borrow the cart. Familiarize yourself with controls, key starter, accelerator, brakes, reverse and steering.
3. The number of passengers in the cart should be limited to the number of seats; most carts are designed for a driver and one passenger. Remind passengers to ‘Hold On’ to grab handles.
4. Never operate the cart after drinking alcoholic beverages or taking drugs. If you are taking prescribed pain medication and it makes you drowsy or unable to concentrate, do not drive the cart.
5. Know what the weather conditions are. If the weather is bad, leave early and adjust your speed when
necessary. Allow more time to get where you are going. Allow for extra stopping distances on wet surfaces.
6. Always drive defensively. Don’t assume you always have the right-of-way. Slow down when you approach pedestrians. Make sure pedestrians are aware of your presence before you pass them. Be aware of and react properly to bicyclists and motor vehicles.
7. Do not drive the cart on public roads if at all possible. Only cross these roads when necessary and obey all traffic signals and rules when crossing.
8. When driving on public roads, (including driveways, walkways) operate the cart as a licensed motor vehicle. Obey all traffic signs and right-of-way rules. Signal all turns and check all directions before making a turn or entering an intersection.
9. When approaching public roads, slow down and stop before entering or crossing the road. Look both ways twice before crossing. Be aware that your cart does not accelerate as quickly as most vehicles. Allow extra time when crossing.
10. If you are on a sidewalk or road and the cart stops or will not operate, push the cart off the sidewalk or road, if possible, and inform the appropriate individual responsible for the cart’s maintenance.
11. Use caution when going downhill, reduce speed, cover brake, and avoid sharp turns.
12. Do not carry equipment or supplies unless properly stored/secured to prevent these objects from falling off carts.
13. Always remove keys and secure the cart when the cart is unattended. Avoid parking on inclines whenever possible.
14. The use of cell phones or texting should never be performed while driving the golf cart.
15. Always abide by the host golf course’s cart and safety rules including the state’s age restrictions.
Video & Photograph Release Form
I hereby grant The Rolling Red Golf Tour (“Rolling Red”) the irrevocable right and permission to use photographs and/or video recordings of me on Rolling Red and other websites and in publications, promotional flyers, educational materials, derivative works, television broadcasts, streaming services, social media posts, or for any other similar purpose without compensation to me.
I understand and agree that such photographs and/or video recordings of me may be placed on the Internet or Television. I also understand and agree that I may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings of me. I waive the right to approve the published product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of the Rolling Red.
I hereby release, acquit and forever discharge the Rolling Red, its current and former trustees, agents, officers and employees of the above-named entities from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.
I hereby warrant that I am eighteen (18) years old or more and competent to contract in my own name or, if I am less than eighteen years old, that my parent or guardian has signed this release form below. This release is binding on me and my heirs, assigns and personal representatives.

If individual photographed/recorded is under eighteen (18) years old, the signer must be a legal guardian: I have read and I understand this document. I understand and agree that it is binding on me, my child, our heirs, assigns and personal representatives. I acknowledge that I am eighteen (18) years old or more and that I am the parent or guardian of the child named that will participating.
